1. About Us

These Terms of Service govern all purchases made through the online shop operated by:

By placing an order on our website, you agree to these Terms of Service.

2. Scope of Application

These Terms apply to all orders placed by consumers through our online shop.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession, as defined by applicable EU and Croatian consumer law.

3. Orders and Contract Conclusion

  • Product listings in the shop are invitations to place an order, not binding offers.
  • By completing checkout, you submit a binding offer to purchase the items in your cart.
  • The contract is concluded when we confirm your order by email or begin preparing your order for shipment.
  • We reserve the right to reject an order, for example if items are unavailable or if there are clear pricing or stock errors.

4. Prices and Payment

  • All prices are shown in euros (€) and include VAT where applicable, unless otherwise stated.
  • Any shipping costs, customs duties, or import taxes are shown or described separately during checkout.
  • Accepted payment methods are displayed at checkout. Payment is due immediately upon order placement unless otherwise stated by the payment provider.

5. Shipping

  • We ship from Kaštel Sućurac, Croatia, to the destinations listed in our Shipping Policy.
  • Shipping costs, delivery options, and estimated delivery times are shown during checkout and explained in our Shipping Policy.
  • Risk of accidental loss passes to you when the goods are delivered to the delivery address you provided.

6. Right of Withdrawal and Returns

If you are an EU consumer, you generally have at least 14 days to withdraw from a distance contract without giving a reason (right of withdrawal), with exceptions for custom-made and clearly personalised goods.

7. Custom and Personalized Items

Custom-made, personalised, or one-of-a-kind pieces created specifically for you are excluded from the right of withdrawal and are non-returnable, except where required by law (for example, in case of defects).

8. Product Characteristics

  • Our ceramics are handmade; small variations in shape, colour, size, or glaze are normal and part of the character of each piece, not defects.
  • Care instructions are provided on the product page or with your order. Damage caused by ignoring care instructions (e.g., dishwasher or microwave use when not recommended) is not considered a defect.

9. Liability

  • We are liable for intent and gross negligence in accordance with mandatory law.
  • For slight negligence, we are liable only for foreseeable, typical damage to life, body, health, or essential contractual obligations (those enabling proper performance of the contract and on which you regularly rely).
  • Nothing in these Terms limits your statutory rights as a consumer under EU or Croatian law.

10. Intellectual Property

All content on the website, including photos, designs, texts, and logos, is the intellectual property of heskxastudio (or used with permission) and may not be copied, used, or reproduced without our prior written consent.

11. Data Protection

We process your personal data in line with EU GDPR requirements. Details on how we collect, use, and store your data are set out in our Privacy Policy.

12. Governing Law and Disputes

  • These Terms are governed by the laws of Croatia, without prejudice to mandatory consumer protection laws of your country of residence within the EU.
  • The competent courts of Croatia shall have jurisdiction, but as an EU consumer you may also bring a claim in your country of residence as allowed by EU rules.

13. Changes to These Terms

We may update these Terms from time to time. The version in force when you place your order applies to that order.
Any changes will be published on this page with an updated “Last updated” date.
